NJDOT to Readopt Rules on
Aeronautics Licensing and Enforcement
The New Jersey Department of Transportation (NJDOT) is proposing to readopt without change rules defining those types of aeronautical facilities that must be licensed by the state (N.J.A.C. 16:54), as well as aeronautical activities that must be licensed such as aerial advertising, aerial application of fertilizers for agricultural uses, aerial mosquito control and parachute schools (N.J.A.C. 16:55)
In addition, the NJDOT is proposing to repeal N.J.A.C. 16:61, the chapter of the New Jersey Administrative Code dealing with aircraft accidents, and combining those provisions with N.J.A.C. 16:60, the chapter dealing with the issuance of summonses and designation of law enforcement officers. The combining of the chapters will create a new chapter entitled "Aeronautical Investigation and Enforcement."
The proposed changes to chapters 60 and 61 will continue to allow the state to provide a focused response to small aircraft accidents occurring in New Jersey. The NJDOT’s Office of Aeronautics provides specialized assistance to local officials who may not have experience in handling and coordinating aircraft accident matters.
The proposed readoption of chapters 54 and 55, and the proposed combination of chapters 60 and 61 are scheduled to be published in the New Jersey Register today. The public has until March 19, 1998 to comment on both proposals.
