DMV Adopts and Concurrently Proposes
Rules Pertaining to Motorcycle Helmet Standards
The New Jersey Division of Motor Vehicles has adopted rules on an emergency basis that establish standards for motorcycle helmets.
The adopted rules and concurrently proposed rules adopt and incorporate by reference Federal Motor Vehicle Safety Standard No. 218 (49 CFR §571.218), as amended and supplemented, as the appropriate standard for motorcycle helmet approval. The adopted rules and concurrently proposed rules also provide that any helmet that meets the Federal standard and the reflectorized surface standard that is set forth in the rules is deemed to be approved by the Director of the Division of Motor Vehicles in accordance with N.J.S.A. 39:3-76.7.
The emergency adoption and concurrent proposal are published in the December 3, 2001 issue of the New Jersey Register. Copies of the emergency adoption and concurrent proposal may be obtained by mail from the Division of Motor Vehicles, 225 East State Street, P.O. The Division has scheduled a public hearing on the concurrent proposal on Friday, December 21, 2001 at 10:00 A.M. at the New Jersey Department of Transportation, Main Office Building, Multipurpose Room, 1035 Parkway Avenue, Ewing Township, New Jersey.
