NJDOT proposes new rules and
amendments governing Utility Accommodation
The New Jersey Department of Transportation proposes to readopt N.J.A.C. 16:25, governing the use of New Jersey Department of Transportation (NJDOT) right-of-way by utility companies, with amendments. The existing rule will expire on July 10, 2003. To avoid expiration of this chapter, the Department must file this readoption with the Office of Administrative Law.
N.J.A.C. 16:25 (Utility Accommodation) establishes the rules to control and coordinate the use of highway right-of-way by utilities including pipelines, overhead power and communications lines, and underground electric power and communications lines.
The Utility Accommodation rules contain standards and requirements for such utility accommodation on NJDOT right-of-way. The proposed rules incorporate current terminology and standards, and reorganize and clean up the documents for consistency and clarity. The Department proposes to repeal N.J.A.C. 16:25-3.3 (Controls for the bury of pipelines), since this section is being amended for clarification and is recodified as part of N.J.A.C.16:25-3.2. A new section at N.J.A.C. 16:25-11.5 is added, which establishes the general requirements for the location of utility facilities within Department-owned railroad right-of-way.
The proposal appears in the July 21, 2003, issue of the New Jersey Register. The public has until September 19, 2003 to comment on the proposal.
