Department of Transportation issues a pre-proposal notice regarding qualification and registration of professionals for expedited permits and other regulatory amendments for expedited permits
The New Jersey
Department of Transportation is developing regulatory amendments
and new regulations pursuant to P.L. 2004, c. 89, which provides
for the expediting of certain Department permits in smart growth
areas.
The proposed
regulatory amendments will be applicable to Access Code permits
as found in N.J.A.C. 16:47, Highway Occupancy permits as found
in N.J.A.C. 16:41, the licensing of Aeronautical Facilities as
found in 16:54, and permits for the creation or expansion of a
prohibited land use or vertical height development within an airport
safety zone as found in N.J.A.C. 16:62. These proposed regulatory
amendments will include, but will not be limited to, the requirements
for expedited permit submissions, the process for appealing expedited
permit decisions, expedited permit fee schedules, and checklists
for expedited permit applications, plans and specification submissions.
The proposed
new chapter is intended to outline the Department's program of
qualification and registration of professionals who will certify
that expedited permit applications are complete and that the statutory
and regulatory requirements for the same have been met by the
applicant, pursuant to P.L. 2004, c.89 and other applicable laws.
This chapter is intended to identify the professionals who may
qualify and register, describe the standards and requirements
necessary for proper administration and enforcement of this program,
and include the basis for suspension or revocation of a professional's
qualification and registration.
The pre-proposal
appears in the December 20, 2004 issue of the New Jersey Register
. The public has until March 20, 2005 to comment on the pre-proposal.

public comment period.
Comments submitted
to the Department on the pre-proposal are public records and are
available for public inspection by prior appointment during normal
Department business hours.
