NJDOT proposing to readopt rules on Compensation of Condemnees for income loss resulting from the harvesting of standing crops

(Trenton) - The New Jersey Department of Transportation (NJDOT) is proposing to readopt without amendment, N.J.A.C. 16:5, Compensation of Condemnees for Income Loss Resulting from Harvesting of Standing Crops. The rules govern compensation to condemnees for loss of income resulting from harvesting of standing crops and other agricultural commodities, in compliance with the provisions of N.J.S.A. 20:3-29.

The proposed rule appears in the July 6, 2010 issue of the New Jersey Register. The public has until September 4, 2010 to comment on the proposal. Persons wishing to comment on the proposal must provide their comments in writing to Miriam Weeks, Administrative Practice Officer, NJ Department of Transportation, PO Box 600, Trenton, NJ 08625-0600. Fax: (609) 530-3841. Comments must be postmarked or sent by facsimile on or before September 4, 2010 which is the close of the 60-day public comment period.

Comments submitted to the Department on the proposed rulemaking are public records and are available for public inspection by prior appointment during normal Department business hours.
