Title VI Overview

The New Jersey Department of Transportation (NJDOT) is committed to protect individuals from discrimination on the bases of their national origin, sex, race, age, disability or color in transportation programs and activities that receive federal assistance, as required under the federal law, Title VI of the 1964 Civil Rights Act (pdf 14k), as amended. The law requires that NJDOT, as a federal-aid recipient, and its sub-recipients and contractors prevent intentional or unintentional discrimination in all programs and activities: Title VI Nondiscrimination Notice to Sub-recipients of Federal Financial Assistance (pdf 164k)

The NJDOT Title VI Compliance and Implementation Plan informs the public and subrecipients of the standard process for reviewing programs and projects to ensure compliance with Title VI of the Civil Rights Act. The plan also informs internal NJDOT staff on the processes to follow in their respective program areas. The Title VI Plan also aids subrecipients on their obligations under Title VI.


NJDOT complies with
  • Executive Order (E.O.) 12898 (pdf) “Federal Actions to Address Environmental Justice (EJ) in Minority Populations and Low-Income Populations,” which requires all federal and state agencies to identify and address the effects of its programs and policies on minority and low-income populations.
  • Executive Order 13166 which addresses services to those individuals with limited English proficiency. The rights of women, the elderly and the disabled are protected under related statutes.
  • Executive Order 14096 (Revised EJ Order) “Revitalizing Our Nation’s Commitment to Environmental Justice for All”. Issued in April 2023, this Executive Order builds on and supplements the foundational efforts of Executive Order 12898. Executive Order 14096 directs Federal agencies to identify, analyze, and address disproportionate and adverse human health and environmental effects and hazards of Federal activities, including those related to climate change. It also directs agencies to actively facilitate the meaningful involvement and just treatment of all people in agency decision-making and other Federal activities that affect human health and the environment.
  • Executive Order 13985 (Equity) “Advancing Racial Equity and Support to Underserved Communities Through the Federal Government”. This Executive Order issued on January 20, 2021, affirms that the Federal Government should pursue a comprehensive approach to advancing equity for all, including people of color and others who have been historically underserved, marginalized, and adversely affected by persistent poverty and inequality. Affirmatively advancing equity, civil rights, racial justice, and equal opportunity is the responsibility of the whole of our Government.
  • Executive Order 14008 (Justice40) “Tackling the Climate Crisis at Home and Abroad”. This Executive Order commits the United States to work with other countries and partners to put the world on a sustainable climate pathway and build resilience against climate impacts. The order also establishes the Justice40 Initiative, which seeks to ensure that 40% of the benefits from federal climate, clean energy, and other investments, including transportation flow to disadvantaged communities.
These Executive Orders and the related statutes fall under the umbrella of Title VI. Census data is used to target Environmental Justice and Limited English Proficiency communities.

NJDOT makes every attempt to consider the needs of low and minority groups when beginning a planning process to ensure they are not adversely impacted by transportation projects. In the event a person believes s/he has been discriminated against, consult NJDOT’s Title VI Nondiscrimination brochure (English) or Title VI Nondiscrimination brochure (Spanish), These documents contain complaint procedures and a complaint form.

Designated Title VI Nondiscrimination Liaisons are the NJDOT division and regional operational areas’ contacts for activities and programs that impact the general public for their respective division/region. Liaisons work closely with the NJDOT Title VI Nondiscrimination Coordinator on specific responsibilities.

NJDOT also monitors access, benefits, participation, treatment, services, contracting opportunities, training opportunities, investigation of complaints, allocation of funds, prioritization of projects and planning, project development, design, Right of Way acquisitions, construction and research on minority, low-income and Limited English proficiency groups.
