Dear Property Owner:
The New Jersey Department
of Transportation (NJDOT)
is embarking on reconstruction
of State Highway 35 from
the entrance to the Island
Beach State Park in Berkeley
Township to the northern
end of the Borough of Bay
Head. This is a 12.5 -mile
stretch of Route 35 that
experienced considerable
damage during the recent
Super-storm Sandy. Preliminary
work for the project is
scheduled to start soon
and will proceed in an
expeditious manner.
This project represents
the first major roadway
improvement to Route 35
in more than 50 years.
The project will include
the reconstruction of travel
lanes, roadway shoulders,
enhanced cross-walks, Americans
with Disabilities Act compliant
ramps, utility work along
the roadside and sidewalks.
In some places, sidewalks
will be constructed on
the State's right-of-way
for the first time.
Over
time, property owners
may have inadvertently
encroached on State Right-of-Way
abutting their property,
contrary to state statute.
While it is possible that
in some cases the contractor
will not need to disturb
encroachments such as
landscaping, fencing, decorative
walls, parked cars, merchandise,
etc., the Department
cannot make any predictions
on a case-by-case basis.
Therefore, the safest course
of action for property
owners is to remove any
materials that are encroaching
on state property if they
wish to protect and reuse
them on their property. The state right-of-way
generally extends 10 feet
off the edge of the pavement
or the face of the curb.
You are encouraged to check
your property line as shown
on your property deed in
the county registrar's
office or as recorded on
the tax maps in your municipality.
The contractors will stake
out the state right-of-way
line but that would mark
the beginning of construction
activities.
This notice is intended
to encourage timely removal
of anything of value from
the State's right-of-way
ahead of the arrival of
project contractors. For
